Gujarat HC to hear petitions challenging liquor prohibition law

A division bench of the Gujarat High Court is set to hear several petitions challenging the Gujarat Prohibition Act, 1949, on 9th October 2023. The controversial act has been in effect for over 70 years.

The petitions, filed in 2018 and 2019, are based on two key grounds: the right to privacy and manifest arbitrariness.

The petitioners argue that the law violates the Right to Equality under Article 14 of the Constitution, as there are no intelligible distinction between who gets to drink and who does not.
